Fireworks are illegal to possess or use in Decatur

With the Fourth of July being tomorrow, the Decatur Police Department would like to remind residents that it is illegal to possess and ignite fireworks within the city limits of Decatur.

Ordinances prohibiting the possession and use of fireworks will be strictly enforced to ensure the safety of all community members.

Numerous city celebrations, such as the Spirit of America Festival, will host public firework displays.

City Ordinances:

Sec. 11-6. Fireworks—Defined.

As used in section 11-7 of this Code, the term "fireworks" shall be deemed to include any explosive composition, or any substance or combination of substances, or article prepared for the purpose of producing an audible effect by explosion, deflagration or detonation, and shall include blank cartridges, toy cannons, in which explosives are used, the type of balloons, firecrackers, sparklers, torpedoes, sky rockets, Roman candles, bombs or other fireworks of like construction and any fireworks containing any explosive compound, or any tablets or other device containing any explosive substance; provided, however, that the term "fireworks" shall not include toy pistols, toy canes, toy guns or other devices in which paper caps containing twenty-five hundredths grains or less of explosive compound are used, providing they are so constructed that the hand cannot come in contact with the cap when in place for the explosion, and toy pistol paper caps which contain less than twenty hundredths grains of explosive mixture, the sale and use of which shall be permitted at all times.

Sec. 11-7. Same—Sale, possession, etc.

It shall be unlawful for any person within the city or its police jurisdiction to sell, offer for sale, keep or have in possession, barter, exchange or give away, furnish at a public place or elsewhere or otherwise dispose of, use or explode any fireworks or pyrotechnics described in section 11-6

of this Code, or to accept the delivery of, receive, have in possession or possess in this city or its police jurisdiction any of these fireworks or pyrotechnics in any quantity whatsoever.
